Terms and Conditions of Service

1. Acceptance of Terms

By creating an account, purchasing an album tier, or uploading photos to Wayni (“the Platform”), you (“Photographer” or “User”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use our services.

2. Service Scope & Platform Role

  • Cloud Distribution Service: The Platform provides cloud-based photo hosting, automated facial recognition indexing via AI, and album distribution software for event photographers.
  • Role of the Photographer: The Photographer acts as the primary operator and Data Controller of the galleries created under their account. The Photographer is solely responsible for obtaining necessary consents from event hosts and guests for capturing and uploading their images.
  • Role of the Platform: The Platform acts purely as a technical Data Processor and infrastructure provider executing automated cloud storage, face-matching, and delivery.

3. Album Quotas, Processing Slots & Lifecycle

A. Processed Slots Quota

  • Each purchased album tier grants a fixed number of Processed Photo Slots (e.g., 500, 1,200, 2,500, or 5,000 photos).
  • Slots are consumed upon processing: Once a photo is successfully uploaded and indexed by the facial recognition system, one processing slot is permanently used.
  • Deletion Does Not Reset Slots: If a Photographer deletes a photo from an album, the raw file is removed from cloud storage, but the processed slot counter will not decrease. Photographers cannot re-use processed slots by deleting and re-uploading files.

B. Automated Album Expiration & Deletion

  • Free Trial Albums: Expire and are permanently hard-deleted 30 days after creation.
  • Paid Albums: Expire and are permanently hard-deleted 90 days (3 months) after creation.
  • Hard Deletion: Expiration applies to the entire album—including original high-resolution photos, watermarked thumbnails, and facial index vectors. The Platform is not an archival or long-term backup service. Photographers must maintain their own local backups of all uploaded media.

4. Payment Policy, Fees & Accommodations

A. Upfront Purchases & Transaction Processing

All album purchases, tier upgrades, and paywall access fees are processed securely in Saudi Riyals (SAR) via Tap Payments supporting local payment methods (including mada, Apple Pay, and major credit cards).

B. Non-Refundable Policy

Due to the immediate consumption of cloud storage, serverless compute, and AI facial indexing resources upon upload, all album purchases are strictly non-refundable once media processing has commenced.

C. Payment Issues & Goodwill Support

  • Transaction & Technical Issues: While album fees are generally non-refundable, we value our photographers and aim to provide flexible assistance. If you experience a payment failure, duplicate charge, network disconnect during checkout, or a technical failure on our platform that prevents album activation, you must notify us immediately at support@wayni.app.
  • Goodwill Accommodations: Upon review of the transaction logs, if an issue is verified, we reserve the right (at our sole discretion) to manually provision or reset your album credit, issue platform credits, or adjust your tier without charging extra fees.

5. Acceptable Use & System Abuse

Photographers agree not to abuse or misuse the Platform. The following actions are strictly prohibited:

  • Illegal Content: Uploading content that is unlawful, defamatory, violent, obscene, or infringes on intellectual property rights.
  • System Exploitation: Attempting to bypass processing quota limits, reverse-engineer the API, test platform vulnerabilities, or launch denial-of-service (DoS) attacks.
  • Unauthorized Biometric Scraping: Using the platform’s facial recognition endpoints to harvest guest facial data or build unauthorized facial databases outside the scope of the specific event.
  • Third-Party Misrepresentation: Impersonating another business or photographer.

Consequences of Abuse

Violation of acceptable use policies will result in immediate consequences, determined at our sole discretion:

  • Temporary or permanent locking of the photographer’s account.
  • Immediate removal and deletion of violating albums.
  • Forfeiture of paid album credits without refund.
  • Legal reporting to local Saudi authorities if unlawful content or activity is detected.

6. Intellectual Property & Media Ownership

  • Photographer Ownership: The Photographer retains 100% full intellectual property ownership and copyright over all photographs uploaded to the Platform. The Platform claims no ownership rights over your media.
  • Platform License: By uploading media, the Photographer grants the Platform a limited, temporary, non-exclusive license to store, crop, watermark, resize, and run facial vector indexing on the media strictly for the purpose of serving the album to event guests.

7. Service Availability & Limitation of Liability

  • “As-Is” Service: The Platform is provided on an “As-Is” and “As-Available” basis. While we strive for 99.9% uptime and rely on tier-1 cloud infrastructure (AWS & Vercel), we do not guarantee uninterrupted or error-free operations.
  • Limitation of Liability: To the maximum extent permitted by the laws of the Kingdom of Saudi Arabia, the Platform shall not be liable for any indirect, incidental, or consequential damages, including loss of revenue, loss of business reputation, or accidental loss of media. Our total cumulative liability to any photographer for any claim shall not exceed the total amount paid by that photographer to the Platform in the preceding three (3) months.

8. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia. Any dispute arising from these Terms or the use of the service shall be referred to and resolved by the competent judicial authorities within Saudi Arabia.
